This is the official The Academic and Athletic Alliance website (‘Site’). This document tells you the terms on which you may use the Site. If you use or register with this Site in any way, you are agreeing to comply with these terms of use, with The Academic and Athletic Alliance privacy policy, with The Academic and Athletic Alliance  contributions policy and with any other terms and conditions on this site (which together are referred to as ‘terms of use’). If you do not agree to these terms of use, you may not use this site.

This Site and all the content on it (including all trademarks, logos, designs, text, graphics, photos, films, and sound), are owned by and remain the property of The Academic and Athletic Alliance. All such content is protected by intellectual property rights. All such rights are reserved.

 

The Academic and Athletic Alliance may also include third-party-owned materials from time to time, which remain the property of their respective owners.

 

Any contributions sent or posted by users of this Site remain the property of the users, but The Academic and Athletic Alliance may use the contributions in the manner described under “Your contributions” below and in The Academic and Athletic Alliance’s contributions policy. Except as expressly stated, nothing in these terms of use or on this Site gives you the right to use any content (including any trademark, copyright, or another right of The Academic and Athletic Alliance or any third party).

 

Your use of this Site

 

The Academic and Athletic Alliance has clearly indicated that you may download materials from this Site, you may only download and use them as indicated or to raise awareness about The Academic and Athletic Alliance.

 

You may not copy, transmit, store, or distribute any part of this Site unless The Academic and Athletic Alliance has clearly indicated that you may do so. You may not alter, modify, adapt, reverse engineer, disassemble or create derivative works of any software contained on this Site. You may not collect or use any personal details from this Site.

 

The Academic and Athletic Alliance reserves the right at its sole discretion to discontinue or amend any aspect of this Site at any time without notice. From time to time The Academic and Athletic Alliance may also restrict access to some parts of the Site, or the entire Site, to users who have registered with us.

 

Support and Advice Service

 

We aim to make our support and advice as useful and reliable as possible, but it might not be relevant or appropriate in all circumstances.

 

If in any doubt, you should consult an appropriately qualified expert for specific advice before acting on any of the information contained in the advice section of the website or any email you receive from us. You should never attempt to carry out any activity which may put you or others at risk. We are not a medical facility and no information we provide should be used to prevent, treat or diagnose medical conditions of any kind. Before starting any exercise regime you should consider consulting a qualified fitness or sports adviser to ensure the regime is suitable. Also, if you have insurance coverage you should check that it covers you for any planned activity. We do not and cannot advise on legal or medical matters.

 

To the extent permitted by law, we accept no responsibility (including loss, damage or injury) for your use of the advice.

 

Your contributions

 

Whenever you want to make a contribution to the Site you must comply with the standards set out in Women in Sport’s contribution policy. You warrant that any such contribution does comply with those standards, and you The Academic and Athletic Alliance for any breach of that warranty.

 

Any material you upload to the Site will be considered non-confidential and non-proprietary, and The Academic and Athletic Alliance has the right to use, copy, distribute, and disclose to third parties any such material for any purpose. The Academic and Athletic Alliance also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to the Site constitutes a violation of their intellectual property rights, or of their right to privacy.

 

The Academic and Athletic Alliance is responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of the Site.

 

The Academic and Athletic Alliance has the right to remove any material or posting you make on the Site if, in The Academic and Athletic Alliance’s opinion, such material does not comply with the standards set out in The Academic and Athletic Alliance Sport’s contribution policy.

 

Linking to the Site

 

You may link to the home page of the Site, provided you do so in a way that is fair and legal and does not damage The Academic and Athletic Alliance’s reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on The Academic and Athletic part where none exists.

 

You must not establish a link from any website that is not owned by you.

 

The Site must not be framed on any other site, nor may you create a link to any part of the Site other than the home page. The Academic and Athletic Alliance reserves the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the standards set out in The Academic and Athletic Alliance’s contributions policy.

 

Links from the Site

 

Where the Site contains links to other sites and resources provided by third parties, these links are provided for your information only. The Academic and Athletic Alliance have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.

 

Unlawful and improper use

 

You may only use this Site for lawful purposes, and you agree to comply with all applicable laws, regulations, and codes of conduct and to be solely responsible for all things arising from your use of this Site.

 

You may not submit, publish, post, distribute, or transmit any defamatory, offensive, infringing, obscene, indecent or unlawful, or objectionable material or information on this Site. You may not interfere with anyone’s use or enjoyment of this Site, for example by threatening, bullying, or sending junk mail.

 

You must not post or send any material or information to this Site that you do not have permission to use, for example, clips of music videos or TV shows.

 

The Academic and Athletic Alliance does not actively moderate this Site. However, if you object to any content on this Site, please email us at info@academicandathleticalliance.org. The Academic and Athletic Alliance in its sole discretion considers that any content, conduct or use of this Site breaches these terms of use or is unlawful or inappropriate in any way, The Academic and Athletic Alliance  reserves the right to do any or all of the following actions (without prior notice):

 

  • Immediate, temporary, or permanent withdrawal of your right to use the Site.

  • Immediate, temporary, or permanent removal of any posting or material uploaded by you to the Site.

  • Issue a warning to you.

  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

  • Further legal action against you.

  • Disclosure of such information to law enforcement authorities as The Academic and Athletic Alliance reasonably feels is necessary.

Any action that Women in Sport take is without prejudice to any of The Academic and Athletic Alliance's accrued rights.

 

Viruses, hacking, and other offenses

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of-service attack.

 

By breaching this provision, you would commit a criminal offense under the Computer Misuse Act 1990. The Academic and Athletic Alliance will report any such breach to the relevant law enforcement authorities and The Academic and Athletic Alliance will cooperate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

 

Academic and Athletic Alliance will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Site or to your downloading of any material posted on it, or on any website linked to it

 

Registration and passwords

If you register to create an account or to access any part of this Site you agree:

  • to keep your password secure and confidential and not to allow another person to use your details or password to access your account or any part of this Site,

  • to notify The Academic and Athletic Alliance immediately if you become aware of any improper or unauthorized use of this Site, your details, or your password,

  • not to do anything which would assist any person who is not a registered user from gaining access to any password-protected area of this Site,

  • not to create additional accounts for the purpose of abusing any person or the functionality of this Site,

  • not to use another user’s account or details, and not to seek to pass yourself off as another user, and

  • that you are solely responsible for all activity that takes place on your personal pages and your account.

You agree that you are solely responsible for your use of this Site and that to the fullest extent permitted at law, The Academic and Athletic Alliance, its trustees, employees, and agents in connection with this Site and your use of it do not make any representations and do not give any warranties, express or implied, concerning this Site (including, without limitation, any content or materials on this Site, and any other websites linked to or from this Site) and in particular does not warrant or represent that this Site or its contents are virus free.

 

Commentary and other materials posted on the Site are not intended to amount to advice on which reliance should be placed. The Academic and Athletic Alliance, therefore, disclaims all liability and responsibility arising from any reliance placed on such materials by any user of the Site, or by anyone who may be informed of any of its contents.

 

You agree that all software provided by third parties (such as Acrobat Reader and RealPlayer) is the sole responsibility of that third party. The Academic and Athletic Alliance is not responsible for the content of any third-party websites linked to or from this Site. Nothing in these terms of use shall exclude or limit any liability for death or personal injury arising from negligence, or for any other liability which cannot be excluded or limited by law.

 

You agree that, to the fullest extent permitted by law, The Academic and Athletic Alliance (and its trustees, employees, and agents) shall not be liable or responsible for any claim, loss, damage, costs or expenses of any nature (including without limitation for any direct, indirect, incidental, special, punitive, or consequential damages, loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, loss of goodwill, wasted management or office time and whether resulting from breach of contract, tort (including negligence) or any other cause of action) arising in connection with this Site or your use of it (including, without limitation, for any contributions to this Site by users, for any viruses, bugs, trojan horses or other contamination resulting from use of this Site, for any interruption or delays to the use of this Site, for any errors, omissions or inaccuracies in any materials on this Site).

 

Indemnity

 

You agree to indemnify The Academic and Athletic Alliance  (and its trustees, employees, and agents) from all claims, loss, damages, costs, and expenses arising in connection with your use of this Site, or your breach of any of these terms of use, or any contribution made by you (or through your account) on this Site. This obligation shall survive the end of these terms of use and your use of this Site.

 

General Provisions

 

If any provision of these terms of use is deemed to be invalid by a court of competent jurisdiction, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect. Any failure or delay by The Academic and Athletic Alliance asserting any of its rights or of any provision of these terms of use shall not constitute a waiver of such right or provision.

 

Governing law

 

These terms of use shall be governed by and construed in accordance with American Law and you agree to submit to the exclusive jurisdiction of the United States courts.

 

This Site is controlled from within the United Kingdom. Women in Sport makes no representations that this Site is appropriate or available to locations outside the United Kingdom. If you wish to access the Site from outside the United Kingdom, you do so at your own risk.

 

Revisions of these terms of use

 

The Academic and Athletic Alliance reserves the right to change these terms of use at any time. You will be bound by any such revisions and should therefore visit this page from time to time to review the terms of use.
